In Child Train Death In CourtDec. 20 - BCN - A trembling
Katrina Hatton appeared briefly in a San Jose courtroom
this afternoon but did not enter a plea to the felony
child endangerment charge she is facing.
Hatton, 20, is charged in connection with the Nov. 21
death of 2-year-old Alexander Arriaga, who was struck
and killed by a train in South San Jose while trying to
cross the tracks. Hatton was watching Alexander and his
brother at the time of the incident.
Hatton teetered on high heels and had to answer "yes
sir" twice before Judge Jerome Nadler could hear her
when he asked if she was willing to waive her
constitutional right to a speedy trial. She is scheduled
to return to court on Jan. 24.
Outside the courthouse Deputy Public Defender Craig
Kennedy said his client is still emotional about
Alexander's death and needed to hurry out of the
courtroom.
"I think she was about to be sick," Kennedy said.
Kennedy said the toddler's death was not the result of
criminal negligence.
"It's a simple defense: it didn't amount to negligence,"
Kennedy said. "It just cried out to me to be a tragic,
tragic accident."
Hatton was released from custody on Dec. 14 and is
currently staying at a battered women's shelter.
